TERMS AND CONDITIONS

Bauer Advisory LLC d/b/a The Highland Method

Last updated: September 1, 2026

These Terms and Conditions (the “Terms”) govern your access to and use of the website located at https://www.thehighlandmethod.com, including its subdomains (collectively, the “Website”), and the courses, videos, audio programs, assessments, downloads, certifications, account features, and related services made available through the Website (collectively, the “Services”).

The Services are offered by Bauer Advisory LLC, doing business as The Highland Method (“The Highland Method,” “we,” “us,” or “our”), located at 8401 Mayland Drive, #5547, Richmond, Virginia 23294.

By accessing the Website, creating an account, registering for free course access, or purchasing a Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Website or Services.

1. Eligibility and United States Availability

You must be at least 18 years old and legally capable of entering into a binding agreement to create an account or purchase a Service.

Paid Services are offered only to customers located in the United States. You may not purchase a paid Service if you are located outside the United States. Organizations interested in licensing outside the United States must contact us for a separate written agreement.

If you use the Services for or on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms. Any separate enterprise order form or written licensing agreement signed by us will control if it conflicts with these Terms.

2. Accounts

Some Services require an account. You agree to provide accurate, current, and complete information and to keep it updated.

Each individual account is personal to the registered user. You may not share, sell, transfer, sublicense, or permit another person to use your account or login credentials. You are responsible for activity conducted through your account and for maintaining the confidentiality of your password.

Notify us promptly at contact@thehighlandmethod.com if you believe your account has been accessed without authorization.

3. Free Framework One Access

Eligible users may register at no cost for access to Framework One: The Individual—The Four Cornerstones™ (“Framework One”).

Unless a different period is clearly disclosed when you register, free Framework One access continues for 12 months beginning on the date of registration. Free registration does not require the purchase of the complete course and does not automatically convert into a paid enrollment or recurring subscription.

We may modify or discontinue the free-access program prospectively. Any change will not reduce an access period that has already begun unless continued access becomes impracticable for legal, security, technical, or third-party platform reasons.

4. The $100 Course Credit

When you register for free Framework One access through an eligible offer, we will provide a $100 promotional course credit toward one purchase of the complete Highland Method course.

The complete course is ordinarily offered through this promotion at a price of $499 before the credit. When the $100 credit is properly applied, the resulting course price is $399, plus any applicable taxes.

The credit:

•         is limited to one credit per person and account;

•         may be used only toward the complete Highland Method course;

•         is valid for 12 months from the date of free Framework One registration, unless a longer period is stated in writing;

•         has no cash value and cannot be redeemed for cash;

•         is nontransferable and may not be sold or assigned;

•         may not be combined with another discount, coupon, or promotional credit unless we expressly permit it; and

•         is applied automatically at eligible checkout when the purchaser uses the same account that received the credit.

If an eligible credit does not appear at checkout, contact us before completing the purchase. A credit cannot be applied retroactively after a purchase has been completed unless we agree otherwise in writing.

We may change or withdraw the promotion for future registrants at any time. A credit already issued will remain subject to the terms that applied when it was issued.

5. Purchases, Payment, and Taxes

Prices and included features are displayed at checkout. By submitting an order, you authorize our payment processor to charge the payment method you provide for the total shown at checkout.

Purchases of the complete Highland Method course are one-time purchases. They do not automatically renew. We will not charge a recurring fee unless you separately and affirmatively agree to a clearly disclosed recurring service.

Prices do not include applicable sales, use, or similar transaction taxes unless expressly stated. Where Bauer Advisory LLC is legally required to collect tax, the applicable amount will be calculated and added at checkout based on the purchaser's location and applicable law. Promotional credits apply toward the course price and not toward applicable taxes. Tax-exempt purchasers must provide valid exemption documentation before completing their purchase.

An order is accepted when we send an order confirmation or make the purchased Service available through your account. We may reject or cancel an order because of an evident pricing error, suspected fraud, payment failure, legal restriction, or unavailability. If we cancel an order after payment, we will refund the amount charged.

6. Course Access

Unless a different term is clearly stated at checkout or in a separate written agreement, purchase of the complete Highland Method course provides the registered individual with 12 months of online access beginning on the purchase date.

Course access is a limited license, not a sale or transfer of ownership. The license is personal, revocable, nonexclusive, nontransferable, and limited to the access period. Access ends when the applicable period expires. There is no automatic renewal.

Materials that we expressly make downloadable may be retained for the purchaser’s personal professional reference, but they remain subject to the intellectual-property and use restrictions in these Terms.

You are responsible for having a compatible device, supported browser, and reliable internet connection.

7. Team and Enterprise Licensing

An individual purchase covers one named user only. Organizations requiring multiple users, centralized enrollment, managed access, or other enterprise features must purchase an appropriate team or enterprise license directly from us.

Team and enterprise pricing, seat counts, access terms, administration, payment terms, and permitted internal use will be governed by a separate written order form or agreement. Purchasing one individual license and sharing it among employees is prohibited.

8. Certification

Users who satisfy the completion requirements displayed in the course may receive a Highland Method certificate of completion. Requirements may include completing designated course components and assessments.

The certification confirms completion of our private training program. It is not an academic degree, professional license, government credential, or guarantee of employment, promotion, compensation, sales performance, or business results.

We may withhold or revoke a certificate obtained through account sharing, assessment misconduct, misrepresentation, or other material violation of these Terms.

9. Refund and Cancellation Policy

Free Framework One registration may be discontinued at any time by stopping use of the Service or asking us to close the account.

Because the paid course consists of digital content made available promptly after purchase, paid course sales are final once access has been granted. We do not provide refunds or exchanges for change of mind, scheduling conflicts, failure to use the course, or dissatisfaction with results, except where required by applicable law.

We will investigate and, when appropriate, correct:

•         duplicate charges;

•         charges resulting from our verified billing error; and

•         a material technical failure within our control that prevents access and that we are unable to resolve within a reasonable time after receiving notice.

Contact contact@thehighlandmethod.com promptly with your name, account email, order information, and a description of the issue. Nothing in this section limits any right that cannot lawfully be waived.

10. Permitted Use

Subject to these Terms, we grant you a limited right to access and use the Services for your own personal professional development or, where an applicable enterprise agreement permits, for authorized internal business training.

You may take reasonable personal notes and use downloadable worksheets for their intended purpose. No other rights are granted.

11. Prohibited Conduct

You may not:

•         share an account or allow an unauthorized person to access course content;

•         copy, reproduce, republish, upload, post, transmit, distribute, sell, sublicense, publicly display, publicly perform, or create unauthorized derivative works from course content;

•         record, screen-capture, download, or extract content except through a download feature we intentionally provide;

•         remove copyright, trademark, or proprietary notices;

•         use course content to create or market a competing course, methodology, certification, product, or service;

•         scrape, crawl, harvest, index, or systematically collect Website or course content;

•         use course content or Website data to train, fine-tune, evaluate, or supply an artificial-intelligence or machine-learning system without our written permission;

•         bypass access controls, probe security, introduce malicious code, or interfere with the Website or Services;

•         use the Services for unlawful, fraudulent, abusive, harassing, or infringing activity;

•         impersonate another person or misrepresent your affiliation; or

•         use the Website to transmit spam or unauthorized commercial communications.

12. Intellectual Property

The Website and Services—including course scripts, videos, audio, graphics, illustrations, assessments, worksheets, page designs, compilations, and other original materials—are owned by or licensed to Bauer Advisory LLC and are protected by applicable copyright, trademark, and other intellectual-property laws.

The Highland Method name, logos, course branding, and source-identifying names and marks, including The Four Cornerstones™, ROI-Driven Selling™, Dual-Track Profiling™, Multi-Cycle Prospecting™, and Criss-Cross Branching™, are claimed as trademarks of Bauer Advisory LLC to the extent protectable under applicable law. Use of the ™ symbol does not represent that a mark is federally registered.

These Terms do not restrict uses permitted by applicable law that cannot be limited by contract.

13. User Communications and Feedback

If the Services allow comments, messages, or other submissions, you retain ownership of your original content. You grant us a nonexclusive license to host, reproduce, and display that content only as reasonably necessary to operate, secure, moderate, and improve the Services.

You represent that you have the rights necessary to submit your content and that it does not violate law or another person’s rights. We may remove submissions that violate these Terms.

If you voluntarily provide ideas, suggestions, or feedback about the Services, we may use that feedback without restriction or compensation, provided we do not publicly identify you as its source without permission.

14. Third-Party Services and Links

We may use third-party providers for course hosting, payment processing, email delivery, analytics, customer support, and other operations. Your use of a third-party feature may also be governed by that provider’s terms and privacy practices.

The Website may link to external websites that we do not control. A link does not imply endorsement, and we are not responsible for external content, availability, security, or privacy practices.

15. Privacy

Our collection and use of personal information are described in our Privacy Policy. Our use of cookies and similar technologies is described in our Cookie Policy.

16. Course Changes and Service Availability

We may update course materials, instructors, examples, assessments, features, and platform presentation to maintain or improve the Services. Updates will not materially reduce the core educational content of a paid course during an active access period without a reasonable substitute.

We do not guarantee uninterrupted or error-free availability. Access may be interrupted for maintenance, security, platform outages, events beyond our reasonable control, or legal requirements.

If we permanently discontinue a paid course during an active access period and do not provide substantially comparable replacement access, we will provide an appropriate remedy, which may include a prorated refund based on the unused portion of the access period.

17. Educational and Results Disclaimer

The Services provide general sales education and professional-development information. They do not constitute legal, tax, accounting, financial, employment, or other regulated professional advice.

Examples, case studies, calculations, and scenarios are illustrative. Your results depend on factors outside our control, including your experience, effort, market, employer, product, pricing, customers, and implementation. We do not promise or guarantee revenue, profit, sales performance, employment, promotion, customer acquisition, or any other particular result.

18. Disclaimer of Warranties

To the fullest extent permitted by law, the Website and Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

We do not warrant that every feature will always be available, that the Services will be uninterrupted or error-free, or that all content will remain current for every industry or situation.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law.

19. Limitation of Liability

To the fullest extent permitted by law, Bauer Advisory LLC and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, lost revenue, lost data, lost business opportunities, or business interruption arising from or related to the Website or Services.

To the fullest extent permitted by law, our total aggregate liability arising from or related to the Website, Services, or these Terms will not exceed the amount you paid us for the Service giving rise to the claim during the 12 months preceding the event giving rise to the claim. If you paid nothing, our aggregate liability will not exceed $100.

These limitations do not apply to liability that cannot lawfully be excluded or limited, including liability for fraud or willful misconduct where applicable. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

20. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Bauer Advisory LLC and its owners, officers, employees, contractors, and affiliates from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of the Services, infringement of another person’s rights, account sharing, unauthorized distribution of course content, or material violation of these Terms.

This obligation does not require you to indemnify us for our own negligence, willful misconduct, or violation of law.

21. Suspension and Termination

We may suspend or terminate access if we reasonably believe that you have materially violated these Terms, shared an account, infringed intellectual-property rights, engaged in fraud or unlawful conduct, threatened security, or failed to pay an amount due.

When reasonably appropriate, we may provide notice and an opportunity to correct the violation. We may act immediately where delay could cause harm, compromise security, enable unauthorized distribution, or violate law.

If we terminate paid access because of your material breach, you will not receive a refund except where required by law. If we terminate paid access for convenience and not because of your conduct, we will provide substantially comparable access or a prorated refund for the unused portion of the access period.

Provisions that by their nature should survive termination—including intellectual-property protections, payment obligations, disclaimers, liability limitations, and dispute provisions—will survive.

22. Changes to These Terms

We may update these Terms from time to time. The updated version will state a new “Last updated” date and will apply prospectively when posted.

If a change materially affects an active paid Service, we will provide reasonable notice through the Website, account, or email address associated with the account. A material change will not retroactively reduce rights already earned under a completed purchase unless required by law or accepted by you.

23. Governing Law and Venue

These Terms and any dispute arising from them are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules.

Subject to any non-waivable right under applicable law, the parties consent to exclusive jurisdiction and venue in the state courts located in Henrico County, Virginia, and the federal courts of the United States District Court for the Eastern District of Virginia, Richmond Division.

25. General Terms

Entire Agreement. These Terms, the Privacy Policy, the Cookie Policy, the checkout disclosures, and any applicable written order form constitute the entire agreement concerning the Services. If a signed enterprise agreement conflicts with these Terms, the signed enterprise agreement controls for that transaction.

Severability. If any provision is found unenforceable, it will be modified only to the minimum extent necessary or severed, and the remaining provisions will remain effective.

No Waiver. Failure to enforce a provision is not a waiver of the right to enforce it later.

Assignment. You may not assign or transfer your rights under these Terms without our written consent. We may assign these Terms in connection with a merger, reorganization, sale of assets, or transfer of the Services, provided the successor assumes our obligations.

Force Majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, except that this provision does not excuse payment obligations already incurred.

Headings. Headings are for convenience only and do not affect interpretation.

Electronic Agreement. Your electronic acceptance of these Terms has the same effect as a handwritten signature to the extent permitted by law.
